Scores of articles have been written on whether the Court should use originalism, and some have examined how the Court employed originalism in particular cases, but no one has studied the overall practice of originalism.
The primary point of this book is an examination of the degree to which originalism influences the Court's decisions. Frank B. Cross tests this by examining whether originalism appears to constrain the ideological preferences of the justices, which are a demonstrable predictor of their decisions. Ultimately, he finds that however theoretically appealing originalism may seem, the changed circumstances over time and lack of reliable evidence means that its use is indeterminate and meaningless. Originalism can be selectively deployed or manipulated to support and legitimize any decision desired by a justice.

Frank B. Cross is the Herbert D. Kelleher Centennial Professor of Business Law at the University of Texas. He is the author of The Theory and Practice of Statutory Interpretation (Stanford, 2009) and Decision Making in the U.S. Courts of Appeals (Stanford, 2007), among other books.

An invaluable concise introduction to constitutional originalism

Theories of constitutional interpretation are always noteworthy, and recently we have been hearing a lot about originalism. This is a theory, currently primarily identified with Justices Thomas and Scalia, that holds that the original meaning and intent of the Constitution control its interpretation. It is often juxtaposed against the "living Constitution" approach which argues that each generation must read its own meaning into the document. Always a hot topic, the recent Second Amendment, Citizens United, and other decisions of the Roberts Court have kept the issue in the forefront.
There are a number of types of originalism, and we are fortunate to have this fairly brief (220 pages or so) introduction by Frank B. Cross. Despite what its title may suggest, it is not an attack on originalism but a thoughtful analysis. I am tempted to say that if you are only going to read one book on this topic, and there are dozens, it should be this one. This book's focus is less on theories and philosophical argument than upon how has originalism actually has worked in practice.
After two introductory chapters exploring the concept establish that the original intention of the framers and the original meaning of the Constitutional language are two principal formulations of the theory, Cross focuses upon what sources are employed by originalists. These include "The Federalist," the records of the ratification debates, dictionaries, Madison's notes of the convention, the Declaration of Independence, and other sources such as correspondence and actions of the first Congress. However the indeterminancy of these materials presents a major problem.
Next, Cross has two interesting chapters on the history of originalism in the Supreme Court: before and after the Warren Court. Some justices used originalism while others rejected it. Surprisingly, it was much used in the Warren Court and often by "liberal" judges such as Black. More heavily, it was employed in the Rehnquist Court, but again surprisingly by Justice Brennan. Justice Souter, quite an outstanding constitutional historian, as well as Justice Stevens, both resorted to historical arguments, often in dissent. In the current Roberts court Cross argues it has been used--but it has not served as a constraining device on judicial discretion, which is one of the principal arguments made by its supporters.
An interesting chapter use quantitative measures to establish how frequently originalism played a role in the history of the Supreme Court, and which sources were relied upon most extensively. Chapter 8 discusses the various theories on what factors influence judicial decisions and whether originalism is just a form of "window dressing" to support a result the particular judge had wanted to reach. Also, it emerges that precedent as a control on interpretation can run straight into originalism; the Roberts Court's obvious willingness to disregard precedent evidences this continuing conflict. A brief epilogue wraps up the book's central themes.
The author's research and command of pertinent sources are outstanding. His bibliographic references, some 16 pages, conveniently identify for the reader most every major source that has discussed originalism. I learned from the book that originalism was a far more complex and interesting theory than I had realized. Cross may not settle the arguments about the viability of originalism, but you will surely have a solid grasp on the concept (including arguments pro and con) after reading this helpful book.
